1) Acceptance; Electronic Signature

By submitting our online form and entering your first and last name, you affirm that you have read, understand, and agree to these Terms & Conditions. Your typed name is your electronic signature and a legally binding agreement to hire and pay for services rendered and to be contacted as described below. You may receive a copy of these terms upon request.

2) What We Do (Scope of Service)

We provide driveway bulk item pickup and related hauling (“Services”). We do not accept hazardous waste or prohibited items (see §6). Our maximum load volume per pickup equals a 6×10 trailer with 3ft sides. If your set-out exceeds our maximum, additional loads are billed at the then-current rate posted on our website in 1/4 trailer increments (using a 6×10 trailer as our unit of measure. We use a multitude of different sized trailers including dumpsters, dump trailers, pickup trucks, flat beds and flat bed trailers that can be much larger than a 6×10 trailer. However, using any sized trailer does not change the pile size estimation when comparing to a 6×10 trailer. The pile size is determined by how much footprint (floor space) your items occupy inside of a 6×10 trailer without stacking them on top of each other. We reserve the right to refuse any items at our discretion, including those that cannot be handled safely. Items we may not accept include, but are not limited to: concrete, gravel, soil, hazardous waste, and full or uncut hot tubs (all hot tubs must be cut into manageable pieces of approximately 50 lbs or less). The lists of accepted and unaccepted items are not exhaustive and may not include every item we will or will not take.

We reserve the right to cancel or refuse your pickup for any reason, including but not limited to, safety, low volume participation, weather or staffing challenges. We may notify you in advance of your cancelation.

3) Scheduling & Access

You agree to set items near the garage or in your driveway (NOT AT THE CURB) or outside of your garage door by the night before (or at least 6am the day of your pick up) your scheduled date and ensure safe access for our driver and vehicle. You must comply with local/municipal/HOA rules for curbside placement and timing (see §7). We may photograph set-outs and pickups to document service. You grant us permission to access your property to retrieve the items. You can only choose one pile location (ex: we will not pick up items at both the curb and the garage for curbside programs.

4) Pricing & Fees

  • Paid Service. We charge based on the amount of items that are ready and accessible for pickup upon arrival.
  • Pricing Method (How Final Pricing Is Determined). You agree to allow our driver to determine the final pile size upon arrival by comparing your actual pile to the pile size example photos on the submission page. Extra costs will be added for specialty items ex: refrigerators, TVs, Electronics, Tires. If your pile exceeds the Max Limit Pile Size, you agree to be charged in extra increments of $50.
  • Trip Charge. A $45 trip charge applies if we arrive but cannot service due to Customer issues (e.g., items not set out, unsafe/inaccessible set-out, violations of §6/§7).
  • Cancellation Policy. Cancel at least 24 hours before your pickup date to avoid a $45 late-cancellation fee. To cancel you must text 608-690-1629. You cannot email to cancel. You must text your name and address and request a cancellation.
  • Late Fees. Invoices are due the same day service is completed. If unpaid after 24 hours, a $40 late fee applies. An additional $10 late fee may apply every 7 days thereafter, up to a maximum of $300 total late fees, after which additional collection or administrative charges may continue to accrue until the balance is paid in full, subject to applicable law. Late fees are intended to cover collection and administrative costs and are not a penalty.
  • Collections Costs. If an invoice remains unpaid, we may refer the account to a collection agency or pursue legal remedies to recover the balance due. Customer agrees to be responsible for all reasonable costs of collection, including court costs, filing fees, allowable interest and attorney’s fees, if applicable and allowable.
  • Disputes (Written Only). All questions, concerns, or disputes regarding invoices—including pile-size classification—must be submitted in writing by email to nationalwastecollection@gmail.com. Verbal or phone disputes will not be accepted. Emailing is not an accepted way to cancel service (see Cancellation Policy above).

5) Payment Terms; Card Authorization

  • Due Date. You agree to pay in full on the service date or within 24 hours via our secure online link. Checks are not accepted.
  • Card on File. If you provide card information, you authorize us (through our PCI-compliant processor) to charge the full amount after completion of the job for any outstanding balance. You may revoke this authorization before we charge the card by contacting us at the info below. We do not store CVV and will provide a receipt.
  • Chargebacks. If you dispute a legitimate charge, you are responsible for any third-party processor fees if the dispute is resolved in our favor.

6) Item Preparation; Prohibited/Restricted Items; Refusal

For safety and compliance, you agree to:

  • Bag and seal small/loose items under 30 lb in regular trash bags.
  • Use a mattress disposal bag for mattresses/box springs.
  • Drain gas/oil/fluids from powered equipment.
  • Glass doors, mirrors or any large glass must be taped to prevent breakage when lifting.
  • Do not set out hazardous waste (solvents, oils, chemicals, asbestos, medical sharps, etc.), refrigerators or appliances with doors attached, or other items prohibited by law or facility rules.
We may decline any pickup for safety/operational reasons (including snow/ice-covered items, items placed directly in the street, no safe or legal parking within ~20 feet, overweight items that cannot be safely lifted, or exceeding limits). If you prepaid for declined items, we will refund the prepaid amount for those items.

7) Curbside Ordinance Compliance (Your Responsibility)

You are solely responsible for complying with local laws and HOA rules regarding placement, timing, and safety (including removing doors from appliances). While we strive to meet schedules, delays can occur (vehicle issues, weather, staffing). You remain responsible for compliance even if a delay causes items to remain out longer than expected. You agree to hold us harmless from fines/citations arising from your curbside placement (see §12(b)).

8) Infestation/Contamination Handling

Do not set out items known or suspected to be infested (e.g., bed bugs) or contaminated or have been in contact with bed bugs at any time, treated and untreated. If infestation/contamination is discovered, we may refuse pickup. If we have already handled or loaded the items before discovery, you agree to reimburse our actual remediation and disposal costs (e.g., PPE, decontamination, special handling, incremental disposal fees).
In addition, you agree to a liquidated cleanup charge of $1,200 per incident as a reasonable pre-estimate of likely costs at the time of contracting; this is not a penalty.

9) Communications Consent (Text, Email, Mail)

By signing up, you expressly consent to receive account-related communications, including payment links and past-due reminders, via text, email, and mail. Message frequency varies with activity; when a balance is due you may receive reminders on day 1, 3, 5, 7, 14, and 21 after the due date. Standard message/data rates may apply.

  • We identify our brand in messages and send during common business hours (generally 8:00 a.m.–8:00 p.m. local time).
  • Opt-out of texts: Reply STOP to stop SMS; we will honor opt-outs promptly. (Email opt-outs apply to marketing; transactional/billing emails may still be sent as permitted by law.)

10) Refund Policy

  • No refunds for no-shows (items not set out), partial pickups when we decline prohibited/unsafe items, or delays (see §11). If we miss your scheduled day, you agree to allow reasonable additional time to complete pickup.

11) Scheduling Changes; Delays; Force Majeure

Pickup windows are estimates. We may reschedule for safety, equipment, weather, or site conditions. We are not liable for delays caused by circumstances beyond our reasonable control (including accidents, breakdowns, severe weather, labor shortages, utility interruptions, governmental actions, or third-party facility closures).

12) Allocation of Risk

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR LIABILITY FOR PROPERTY DAMAGE OR OTHER LOSSES ARISING FROM THE SERVICES IS LIMITED TO DIRECT DAMAGES UP TO THE AMOUNT YOU PAID FOR THE SERVICES GIVING RISE TO THE CLAIM OR $500, WHICHEVER IS GREATER. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, EXEMPLARY, OR CONSEQUENTIAL DAMAGES (INCLUDING LOST PROFITS, LOSS OF USE, OR DIMINUTION IN VALUE). THIS LIMITATION DOES NOT APPLY TO DAMAGES CAUSED BY OUR GROSS NEGLIGENCE OR WILLFUL MISCONDUCT.
(b) CUSTOMER INDEMNITY (ORDINANCES/PROHIBITED ITEMS). You agree to defend, indemnify, and hold us harmless from fines, penalties, claims, or costs (including reasonable attorneys’ fees to the extent permitted by law) arising from your violations of local ordinances/HOA rules (see §7) or from prohibited/unsafe items you set out (see §6).
(c) NO PROFESSIONAL WARRANTIES. Except as expressly stated in these Terms, the Services are provided “as-is” and without any implied warranties.

If an invoice remains unpaid, we may: (i) apply late fees under §4; (ii) contact you using the methods in §9; (iii) refer the account to a licensed collection agency; and/or (iv) pursue legal remedies, including small claims where appropriate. A collections referral may affect your credit profile if reported by the agency.
If we pursue legal remedies, we may seek court costs and other amounts expressly permitted by applicable law and this agreement. We will not seek any amounts prohibited by law.

14) Governing Law; Venue

These Terms are governed by the laws of the State of Wisconsin. Exclusive venue for any action arising out of or relating to the Services shall be the state courts located in Dane County, Wisconsin, including small-claims court when applicable.
